AGB / Terms and Conditions
These terms govern the provision of CAM programming, G-code optimization, post-processor modification, CAM/CNC consulting and CNC Wizard SaaS tools by CAMOutput.
1. General Provisions
These terms apply to all business relationships between CAMOutput (Contractor) and its clients (Client).
By placing an order or using the services, the Client agrees to these terms.
2. Scope of Services
The Contractor provides CAM programs, G-code, machining strategies, post-processor modifications, technical consulting and digital CNC SaaS tools (for example G-code optimizer).
Service scope is defined by the accepted quotation, order confirmation or written agreement.
3. Collaboration and Communication
The parties cooperate via email, online meetings, messaging and project management channels agreed in writing.
The Client shall provide complete and accurate technical inputs (machine data, tooling data, material, tolerances, drawings and setup constraints) in due time.
4. Responsibility and Limitation of Liability
The Contractor is responsible for programming errors directly resulting from the CAM program, G-code or machining strategy delivered by the Contractor.
The Contractor is not liable for damages caused by incorrect machine operation, incorrect setup, wrong tool data, missing maintenance, or deviations outside supplied specifications.
5. Client Obligations (Machine Operator)
The Client is solely responsible for machine operation, tool entry, tool changes, tool clamping, zero point setting (null point), machine control and all operator actions.
The Client must verify each program before production and stop execution immediately if unsafe behavior is detected.
6. Safety Recommendations for NC Programs
Before machine execution, the Client should perform collision checks, travel-limit checks and fixture-clearance checks.
For first execution, operation by an experienced operator is strongly recommended.
During first execution, a step-by-step operation by individual operations is strongly recommended.
7. Testing and Simulation of NC Programs
Simulation and a controlled test run are recommended before serial production.
The Client remains responsible for final validation under actual machine conditions before releasing production.
8. Payment and Payment Terms
Fees are based on the accepted offer unless otherwise agreed in writing.
Invoices are due within the payment period shown on the invoice. In case of delay, statutory default interest and recovery costs may be charged.
9. Digital Services and SaaS Tools
SaaS tools are provided on an “as available” basis and may be updated, improved or modified for security, stability and performance reasons.
The Client must use SaaS tools in compliance with applicable law and must not misuse, reverse engineer or interfere with service availability.
10. Intellectual Property
Unless otherwise agreed, all pre-existing intellectual property of each party remains with that party.
Upon full payment, the Client receives usage rights for delivered outputs to the extent required by the agreed project purpose.
11. Confidentiality
Both parties must keep confidential all non-public commercial and technical information received during cooperation.
Confidentiality obligations survive termination of the contractual relationship.
12. Liability Insurance
The Contractor maintains professional liability insurance (Berufshaftpflicht/Betriebshaftpflicht) covering damages caused by programming errors within policy terms and limits.
13. Liability Cap to Order Value
Except in cases of intentional damage, the Contractor’s total liability is limited to the value of the respective order.
14. Governing Law and Jurisdiction
Applicable law and competent court shall be determined by the legal seat stated in the Contractor’s imprint/impressum and mandatory statutory provisions.
